Terms of Service

Nibit is operated by Crouton Creations, LLC, a Washington state company located at 100 N Howard St Ste R, Spokane, WA 99201. By using Nibit, you agree to these terms.

1. Who Can Use Nibit

You must be at least 13 years old to use Nibit. If you are under 18, you must have parental or guardian permission. You may not use Nibit where prohibited by law.

By creating an account, you confirm that you meet these requirements and that any information you provide is accurate.

2. Your Content

Nibit lets you create and manage text snippets, actions, transforms, and other content. Here is how we handle it:

  • Your content stays yours. You retain ownership of everything you create in Nibit.
  • Local-first storage. All content is stored locally on your device by default.
  • Cloud sync (optional). If you create an account, your content is synced to our servers so you can access it across devices. Synced content is only accessible to your account.
  • License to us. You grant us a limited, worldwide, non-exclusive license to host, process, and transmit your content solely as needed to provide the sync and AI features you use.

3. AI Features

Nibit offers AI-powered text transforms and dictation. When you use these features:

  • Your text is sent to our servers and forwarded to third-party AI providers to generate a response.
  • AI outputs may be inaccurate, incomplete, or unexpected. You are responsible for reviewing and verifying any AI-generated content before use.
  • We do not use your content to train general AI models.

4. Subscriptions and Billing

Subscriptions. Paid plans are billed on a recurring basis and will automatically renew until you cancel. You can cancel your subscription at any time. Cancellation takes effect at the end of your current billing period.

In-app purchases. Payments are processed through Google Play. Google Play's terms and refund policies apply.

Refunds. Refund requests are handled on a case-by-case basis. If you have a billing concern, please reach out to [email protected].

5. Acceptable Use

You agree not to use Nibit to:

  • Generate content that is harmful, abusive, sexually explicit, or illegal
  • Attempt to circumvent the service's safety filters or rate limits
  • Reverse engineer, scrape, or extract data from the service beyond normal use
  • Use the service to build a competing product
  • Interfere with or disrupt the service, or attempt to gain unauthorized access to any part of it

We reserve the right to suspend or terminate accounts that violate these terms.

6. Privacy

Your privacy matters to us. Our Privacy Policy explains what data we collect, how we use it, and your rights. By using Nibit, you also agree to our Privacy Policy.

7. Intellectual Property

Nibit, including its name, logo, design, and code, is owned by Crouton Creations, LLC and protected by applicable intellectual property laws. These terms do not grant you any rights to our trademarks or branding.

8. DMCA / Copyright Policy

We respect intellectual property rights. If you believe content on our service infringes your copyright, please send a notice including the information required by 17 U.S.C. Section 512(c)(3) to:

9. Disclaimers and Limitation of Liability

Nibit is provided "as is." We make no guarantees that the service will always be available, error-free, or that generated content will meet your expectations.

To the fullest extent permitted by Washington law, Crouton Creations, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. Our total liability for any claim is limited to the amount you paid us in the 12 months prior to the claim, or USD $100, whichever is greater.

10. Governing Law and Disputes

These terms are governed by the laws of the State of Washington, without regard to conflict of law principles.

You and Crouton Creations, LLC agree that any dispute arising out of or relating to these terms or the service will be resolved by binding arbitration administered by JAMS under its Streamlined Arbitration Rules, conducted by a single arbitrator seated in Spokane County, Washington. Disputes will be arbitrated only on an individual basis and not as a class, collective, or representative action.

Either party may bring an individual action in small claims court or seek injunctive relief in court to protect intellectual property rights.

Opt-Out. You may opt out of arbitration within 30 days of first accepting these terms by emailing [email protected] with subject line "Arbitration Opt-Out."

11. Changes to These Terms

We may update these terms from time to time. For material changes, we will provide at least 30 days' notice (e.g., in-app or by email). Continued use of the service after notice means you accept the updated terms.
